7shifts can flag every California meal, rest and split-shift exception before and after the shift, but only once you set the jurisdiction to California and clock in through 7punches or a POS labor integration. It warns and records; your payroll still has to pay the one-hour premium.

How we wrote this

We followed 7shifts’ California Labor Compliance help article (updated 27 Oct 2026) and the California DLSE meal period FAQ, both read on 4 November 2026. We have not run these settings on a live 7shifts account for this guide. This is general information, not legal advice.

The rules 7shifts is checking

RuleCalifornia law (DLSE)What 7shifts flags
1st meal break30 min for work over 5 h, by end of hour 5Missing, or not started by 4:59
2nd meal breakWork over 10 h, by end of hour 10Required count not taken
Rest breaksPaid, at least 10 min1–4 by shift length; a meal break cannot double as a rest break
Premium1 h at regular rate per workday1 h at regular rate per exception
Split shiftPremium at minimum wage, offset by pay above itTwo punches same day 60+ min apart
Reporting pay2–4 h at regular rateUnder half the scheduled day, or under 2 h

Note the difference in the premium line: the law sets one premium hour per workday for meal periods, while 7shifts describes one hour per exception. Check with payroll or your employment lawyer how you apply it before paying from the report.

Setup, step by step

  1. Sign in to the 7shifts web app as an Admin.
  2. Go to Settings > Company Settings > Labor & Compliance.
  3. Under Jurisdiction, pick California, or California – Berkeley, Emeryville, LA County or San Francisco if a local scheduling ordinance applies.
  4. Review overtime, break and wage settings. Choosing California sets overtime to the regular rate of pay, a weighted average across roles.
  5. In Advanced Labor, tick the California options you need, then Save. Re-sync labor & compliance settings restores the defaults.
  6. Enable Meal Breaks, then waivers, and add punch-out attestation with the meal break question.
  7. For staff with signed waivers, go to Team > Employee > Employment and mark ‘6hrs & out’ or ‘10hrs & out’. You can also enable automatic dismissal of waived meal breaks.
  8. Location-level overrides live in each location’s Labor & Compliance section.

Managers need the “Can manage time punches”, “Can manage exceptions” and “Can run reports” permissions to see reporting pay and exceptions.

Where exceptions show up

  • Schedule: a warning with the exception type and cost when an edit would cause one, plus a summary before you publish.
  • Shift pool: a warning when an assignment would cause one.
  • Time clocking: exceptions on each punch, where you can dismiss (waiver or attestation) or restore them.
  • Reports: Labor Exceptions, Punch Audit, Attestation, and Worked Hours and Wages.

Building a schedule that avoids them

Put the meal break inside the first five hours of every shift over five hours, for example a 10:00 start with the break by 14:30. Avoid gaps of 60 minutes or more between two shifts on one day unless you mean to pay a split-shift premium. If you also pool tips, see 7shifts vs Homebase tip pooling. Australian operators have different rules; see Deputy vs 7shifts for the Australian award.

FAQ

When must a California restaurant worker get a meal break?+

Per the DLSE, a 30-minute meal period is required for a work period of more than five hours, no later than the end of the fifth hour. A second is required over ten hours, no later than the end of the tenth hour. The first can be waived by mutual consent if the day is no more than six hours; the second if the day is no more than twelve hours and the first was not waived.

What is the penalty for a missed meal break in California?+

One additional hour of pay at the employee's regular rate for each workday the meal period is not provided (Labor Code 226.7). The DLSE says this hour does not count as hours worked for overtime, and claims can be filed within three years.

Does 7shifts pay the meal break premium automatically?+

7shifts flags the exception and its cost on the schedule, time clock and Labor Exceptions report. You still review it and make sure the premium reaches payroll. The report only works if you use 7punches or a POS labor integration.

Can a rest break be waived in 7shifts?+

No. 7shifts says rest break exceptions cannot be dismissed with a waiver; each missed rest break needs employee attestation.
